It is a requirement to make purchases on www.nguillers.com hereinafter the Web Site, Any person or company (through an authorized contact person or legal representative) who makes transactions on this Web Site declares that he/she knows and accepts these Terms and Conditions. Likewise, for any user or visitor of this Web Site it is understood that he/she knows and accepts each and every one of the Terms and Conditions.

In these Terms and Conditions, visitors to the Website, prospective purchasers and purchasers are collectively referred to as the "Customers".

The Web Site

SAS, hereinafter “Novedades Guillers”, legally constituted and located in Bogotá, Colombia - South America; registered before the Chamber of Commerce of Bogotá, operates the Web Site under the domain www.nguillers.com by which the Clients have the possibility to:

1. Consult free of charge and without being subject to any kind of monetary obligations or purchases on the Website, public information regarding Tutorials, Encyclopedia, and Jewelry techniques among other publications or articles, as a guide for the proper use, work or elaboration of accessories. This free material is for informational purposes only and does not constitute any kind of warranty or obligation of Novedades Guillersbefore the Customers, for possible damage caused to products purchased on this Web Site, by handling, misuse or deterioration by the buyer.
2. Purchasing the products published on this Website for personal decorative purposes, whether they are finished or the components for the elaboration of the same, which in turn are the sole responsibility and knowledge of the Customers. Novedades GuillersNovedades Guillers does not provide the services of design, assembly, assembly, assembly or packaging of accessories to Customers or third parties.

Secret Password

Procedure for using this Website

Through our Website, Customers are informed in an unequivocal and easily accessible manner of the steps, requirements and conditions to be followed in order to purchase products through the Website.

The Website indicates the postal and/or e-mail address of Novedades Guillers and the technical means available to Customers to identify, update and correct errors in the shipment or in their data. All Customers registered on the Website may request proof of authorization for the processing of their data, ask Novedades Guillers for information regarding the use that is being made of them, revoke the authorization or request the deletion of their data.

National Minimum Purchase Amounts

Due to the freedom that Novedades Guillers wants to offer its customers in each of their purchases there is no minimum purchase amount  for domestic shipments (it is understood and limited to orders within Colombia).

International Minimum Purchase Amounts.

Due to the costs of handling, transportation and international shipping, Novedades Guillers has as a minimum amount for international purchases and shipments the value of USD200.00, not including transportation costs and customs taxes generated in the country of destination, which must be assumed by the buyer or recipient.

In the values informed of minimum amount for international shipments are not included charges, taxes, or any kind of monetary requirements by the customs of the country of destination to the customer or recipient, who will be solely responsible for any additional value to be paid.

Means of Payment

If Customers decide to purchase any of the products published on the Website, they may use the means of payment informed, selecting the payment option of their preference, either Payments with Debit/Credit cards, PayPal, Consignment and electronic bank transfer (the account is informed in the purchase process), National or International Drafts or cash payment in our store, taking into account the order number or invoice number as appropriate. In the case of companies that send couriers must have the corresponding accreditations, prior to the delivery of orders.

In some of the cases or means of payment, it will be necessary for Customers to provide their financial information, including specific credit card information, address where they receive invoices, telephone number and address to which Novedades Guillers wishes to send its products. Novedades Guillers does not capture, collect or store any information related to electronic means of payment such as credit/debit cards, bank wire transfers or others.

In the event that Customers wish to pay for their orders by combining or using 2 or more means of payment for a single order, they must previously notify their intention and selection of the means of payment to be used, specifying them together with the values to be paid for each one, through an e-mail message to the account ventas@nguillers.com.co In these cases, the order will be dispatched once the payments have been received and confirmed successfully and corresponding to 100% of the value of the order.

Shipment of Orders

Purchases made through the Web Site will be shipped through the carrier that covers or reaches the place requested by the Customer in the purchase process.

The delivery of orders can be requested only for our headquarters in BOGOTÁ; it can be made to third parties only and previously authorized by the account holder. The authorization must be made in writing by sending an email to ventas@nguillers.com.co informing the name and identification document of the person who will claim the goods, which, at the time of claiming the goods, must have the name of the account holder, order number or invoice number as appropriate. In the case of companies that send couriers, they must have the same accreditations and certifications for the delivery of orders.

Shipment of Orders through courier companies

The Customer shall be solely responsible for the shipping data of orders, (Address, Recipient, Destination City, Telephone and others), according to the purchase process on the website and the freedom to fill in the required fields for shipping. In case the Customer has requested a shipment with wrong data, after the order shipment confirmation, the Customer must inform in writing to  ventas@nguillers.com.co the correct shipping information to Novedades Guillers, who will communicate with the corresponding carrier and request the correction of the relevant data (s), therefore delivery times will vary as stipulated by the carrier responsible. Novedades Guillers will not assume or be in any kind of monetary or in-kind debt to the customer for delays, misdeliveries or losses due to errors in information provided by the customer, or errors on the part of the carriers.

Responsibility for shipments through transport companies

Novedades Guillers informs and clarifies that the responsibility for the package containing the order placed by the Customer (through the website, in the warehouse, or by other means), ends at the time of delivery to the carrier (selected by the customer or not), which will assume full responsibility for it from the receipt of the package, until the final and correct delivery to the customer or recipient.

In case of delays, delivery errors or loss of packages, it will be the customer who will contact the carrier for the respective tracking and tracing; for this purpose, Novedades Guillers will have previously informed the tracking number and carrier company by which the shipment was made. In the event that the carrier does not provide the information on the status of the shipment to the Client or recipient, only the Client who appears as the holder of the purchase must inform Novedades Guillers by telephone or in writing the situation, requesting verification between the carrier and the recipient.

Eventually Novedades Guillers will make the request before the corresponding transport company requesting the information, correction or compensation, as the case may be. Novedades Guillers will not assume or be in any kind of monetary or in-kind debt to the customer for delays, wrong deliveries or losses due to handling and logistic errors of the transportation companies.

Shipping Costs

For both National and International shipments, there are no fixed shipping costs, since they depend on and vary according to the characteristics of each of the packages to be shipped, taking into account the following particularities:

Coverage and routes of national carriers.

Novedades Guillers makes clear and emphasizes that not all national destinations are covered by all carriers; in case the carrier requested by the customer for the shipment of your order does not cover the destination, Novedades Guillers will select another company and will inform the customer prior to shipment, through a service of equal or lesser value than requested. If the service is of lesser value, the difference will remain in the customer's account as a credit for future shipments and will be deducted directly from the shipping cost (freight) only.

Delivery times for domestic shipments

Delivery times for domestic shipments are established by most carriers in times of 1 to 2 business days for major cities and 3 business days onwards for intermediate cities. Main cities are understood as department capitals or cities of greater development and intermediate cities as small cities, towns, villages, villages, villages and others, additionally the delivery time depends entirely on the carrier selected by the customer and may be affected by other uncontrollable factors such as weather and road conditions, disasters, demonstrations, accidents, intervention or review by the DIAN, among others.

Delivery times and taxes on international shipments

Delivery times for international shipments depend entirely on particularities, which are not controllable by Novedades Guillers (except for the day of shipment) and must be taken into account by customers when making their purchases, additionally customers should know and understand that, depending on the laws and regulations of import in force in each of the countries outside Colombia, the customs of the destination country can and eventually will generate taxes for entry and nationalization of goods and / or additional, which must be borne by the customer or recipient. The following variables affect the delivery times of international orders (outside Colombia):

• Day of shipment
• Transport company and type of service.
• Routes of transportation of goods.
• Customs regulations, laws and procedures (in the destination country).

Likewise Novedades Guillers refrains from shipping orders to countries that are in socio-political conflicts or others and that may eventually affect our free commercial development with customers, for additional charges, retention of goods, restrictions, limitations or similar that may involve the company in conflicts that harm our conduct, name and image to the rest of the world.

FREE SHIPPING OF ORDERS

Only for Customers who are registered on the Web Site www.nguillers.com who make individual purchases with the following characteristics, Novedades Guillers makes free shipping of the order, for which assumes 100% of the shipping costs and transportation insurance, to the address registered in the purchase process:

1. The purchase must be equal to or greater than COP $600.000; understood by total value of the merchandise to be purchased, without including or adding freight, consignment surcharges and others.
2. This value may vary without prior notice. The payment method for free shipping can be any of those available in the purchase process in the Web Site www.nguillers.com 
3. Applies only for shipments within Colombia, in standard or basic services. Special services are not covered by Novedades Guillers.
4. Free shipments are made through the transportation company Coordinadora Mercantil. In case the customer requests the shipment of the order by a different carrier, it will be the customer who assumes the total cost of shipping by that company. In this case, the shipment will be made by freight on delivery.

Discounted shipping/transportation costs for International Orders

For customers outside Colombia who decide to make purchases through this Web Site, Novedades Guillers will grant as a temporary promotion and assume 20% of the value of transportation or shipping of the goods to the place of destination registered in the purchase process and the customer will assume the remaining 80%, included in the quotation of the order and registered as "FREIGHT", for which the following characteristics will be taken into account:

1. Minimum purchase of USD 200.00
2. Confirmation of payment by any means within the following 5 working days, after receiving the quotation and payment information / selected means of payment.

Restrictions on FREE SHIPPING or DISCOUNT ON INTERNATIONAL SHIPPING COSTS

Although customers who have made purchases, complying with the conditions stipulated for FREE SHIPPING or DISCOUNT ON INTERNATIONAL SHIPPING COSTS, Novedades Guillers will not apply the promotion for orders that:

1. Exceed the weight and volume limits stipulated below:

• Maximum weight of 10 Kilos total.
• Maximum volume: Maximum box dimensions allowed 40 cm X 30cm X 40cm, as 1 (one) box in total.

2. The destination city is not included in the following list (national shipments):

• Armenia (Quindío).
• Barranquilla (Atlántico).
• Bogotá (Cundinamarca).
• Bucaramanga (Santander).
• Buga (Val).
• Cali (Val).
• Cartagena (Bol).
• Cartago (Val).
• Chía (Cundinamarca).

IT SHOULD BE CLEAR THAT: If the order placed through the website, email or any other means meets the conditions and requirements of ENVIO GRATIS, but but the destination city is not included in the list mentioned, the order will be sent in freight payment mode on delivery, through the company COORDINADORA MERCANTIL S.A. or the one that covers the destination route and the customer or recipient who assumes the costs generated by the concept of transportation to destination.

Considerations of free shipping or discount on international shipping costs.

It is clarified that the free shipping or discount on international shipping costs granted by Novedades Guillers, are timeless promotions without validity and therefore may be terminated or modified without notice, without the right to claim on these promotions, by Customers to Novedades Guillers.

In case of being terminated or modified, orders that have been received until the business day prior to the date of change and that meet the characteristics mentioned above, will be sent free of charge or with a discount on international shipping costs, with the established conditions. For orders arriving on or after the day of the change, they will be shipped with the new shipping policy, being the Customers who assume the total or excess costs related to the shipping.

As these promotions are granted by Novedades Guillers they cannot be accumulated with other promotions, nor do they apply for returns. The promotion applies to one-time purchases, so they are not cumulative with other purchases after invoiced, even from the same account or third parties; it is not redeemable in cash and/or products.

In the event that Customers make purchases that meet the requirements for free shipping or discount on international shipping costs mentioned in these Terms and Conditions and request that the order be delivered at Novedades Guillers, the company WILL NOT incur in any kind of debt or monetary or in-kind retribution by Novedades Guillers to Customers. Likewise, in case of not using the free shipping or the discount on international shipping costs, promotions cannot be used or transferred to future purchases or to third party purchases.

On the contrary, customers who make purchases in Novedades Guillers Stores, with the aforementioned characteristics, can ONLY use the free domestic shipping.

Formation of the Purchase Consent

The consent of the consumer is manifested in the steps of the purchase process of the Web Site by entering the requested information according to their preference in terms of payment or shipping and is authorized with the final manifestation of purchase after reviewing the order summary. Before the final confirmation of purchase, Customers may read these Terms and Conditions or unilaterally cancel the purchase at any time without becoming indebted or incurring obligations with  Novedades Guillers.

Novedades Guillers will issue an acknowledgement of receipt of the order to the e-mail registered by Customers upon registration, with information on the shipment of orders, exact price, including taxes, shipping costs and how the payment was made.

Strikethrough Prices or Discounts

When the Website shows a crossed-out price and instead the sale price is indicated, such crossed-out price corresponds to a percentage decrease of the initial sale price of the products by mere liberality of Novedades Guillers, this price will always be lower than the price initially offered by Novedades Guillers, will be valid and / or restrictions depending on the product, season or condition of sale. Likewise, we make clear that products with crossed out or discounted prices have no change, except for quality problems.

WARRANTY

Invalidity of the Right of Withdrawal

Novedades Guillers sells goods, products and / or components for making accessories for personal use; therefore, according to current regulations, the right of withdrawal may not be exercised under any circumstances. This is what the Customers declare to be known and accepted by accepting these terms and conditions. The above, without prejudice to the possibility of changes voluntarily granted by Novedades Guillers to its customers with respect to those products that Novedades Guillers expressly indicates.

Change policies

In the event of defects in the quality, purpose or suitability of the products purchased through the Website within the warranty period of the respective product, the legal warranty may be used in the terms stipulated in these Terms and Conditions.

In order to make changes and according to the warranty policy of Novedades Guillers it is not required that the object of the contractual obligation has been defective or useless for normal use. In order to proceed with the changes, it is required that it is requested within the limit of the warranty term of the respective product, in case of deficiencies in manufacturing, processing, materials or in case it is not entirely suitable or useful for the final use or consumption for which it is intended.

Therefore, Customers have five (5) working days from the date of purchase or receipt of the goods, in the case of purchases made through the Website, to make use of the NGUILLERS warranty, which can be consulted at the end of this document.

Different products delivered from those ordered

When the delivered product does not correspond to what was ordered, or when it corresponds to an unsolicited operation, Customers will have the right to request the resolution by NG guarantee and obtain any of the established options, either 100% Exchange, 100% Replacement or 100% Credit. In the latter, the credit note for the value of the purchase, without any retention or discount, will be valid and may be effective until December 31 of the year in which the purchase was made.

In order to proceed with the issuance of the exchange, replacement or credit note, the product to be exchanged must be in Novedades Guillers; facilities; for this, Customers must give notice to the customer service area about their intention to return the product within five (5) business days from the date of the initial purchase; Customers are responsible for sending to Novedades Guillers the product(s); once received, it is validated that it (they) is (are) in the conditions of change required by the company. Novedades Guillers will assume the costs of returning goods only when the product does not meet the quality conditions required for the intended use, or when products are sent by mistake different from the one requested in the final order.

With respect to the products of cut by meter sale as Guayas, Leathers, Cords, Wires, Neoprene, Strass, Chains and others (in all materials or coatings) will not proceed changes for reasons other than those mentioned above or by those expressly provided by law. That is to say, for these products no changes shall be made for reasons attributable to the continuous use of the material in different lengths.

With respect to the other product lines mentioned on the Website, before the first five (5) working days from the receipt of the product or date of purchase, changes will be made when the reasons are attributable to personal taste or appreciation of the Customers. The product must be unused, unaltered, unmodified, in the quantities invoiced, in perfect condition and must have the original packaging in the event that the defect of the good could have been detected at first sight, such as when it is a different color, model or shape than the one requested. In this type of exchanges, Customers assume all the costs of handling, transportation and shipping to Novedades Guillers and back.

THE WARRANTY DOES NOT COVER

1. Use, wear, dirt and normal aging of the articles.
2. Loss of stones or ornaments, if applicable.
3. Any damage to the item resulting from misuse, lack of care, negligence, accidents, bumps, crushing, liquids or inappropriate products in normal use or operation.
4. Alterations, repairs or adhesions made on the articles.
5. Damage caused by the application of cosmetic and/or cleaning products (creams, perfumes, soaps, detergents, etc.), as these may stain the coatings or color applications.
6. External coatings, veneers and color applications.
7. Accessories in leather, imitation leather, synthetic materials, rubber, ribbons and others.
8. Discounted products.

DATA PROCESSING POLICY

Use of Personal Data Registered on the Website

The mere registration of Customers on the Website shall be the express, informed and prior acceptance for access, filing and use of Customer information provided through the Website, including but not limited to their personal information and sensitive data, by Novedades Guillers and third parties authorized in these Terms and Conditions. The purpose of the processing of personal data of Customers will be to validate purchase orders, improve the information work of the Website, support and improve marketing, communication strategies and promotion of products or services provided on the Website, analyze Customer profiles, circulate and send general, promotional or commercial information of Novedades Guillers.

With the acceptance of these Terms and Conditions, Clients declare freely, expressly and previously to have been informed about the rights that the regulations and jurisprudence grant to them as holders of their personal data and which are set forth below: (I) To know, access, update and rectify their personal data against Novedades Guillers or any person responsible for or in charge of the processing of their personal data. This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned, misleading data, or data whose processing is expressly prohibited or has not been authorized. (II) Request proof of the authorization granted to the data controller or data processor, except when the law expressly exempts it as a requirement for processing. (III) To be informed by the data controller or data processor, upon request, regarding the use made of the personal data. (IV) To file complaints before the Superintendence of Industry and Commerce for infringements to the personal data protection regime. (V) To revoke the authorization and/or request the deletion of the personal data when the processing does not respect the constitutional and legal principles, rights and guarantees. The revocation and/or suppression will only proceed when the Superintendence of Industry and Commerce has determined that in the treatment the responsible or in charge have incurred in conducts contrary to the law and the Constitution. (VI) Access free of charge and voluntarily and unlimitedly to their personal data that have been subject to treatment. Likewise, Clients acknowledge that it shall be their power to provide the Company with information on sensitive data and that it is under their full discretion to provide any sensitive or non-sensitive personal data that may be required by Novedades Guillers.
